Forged Racing ("Forged Racing," "we," "us," or "our") operates forged-racing.com and the related shopping, customer support, and communications services we provide (collectively, the "Services"). Our online store is powered by Shopify.

This Privacy Policy explains how we collect, use, disclose, and retain personal information when you visit our website, shop with us, create an account, subscribe to our communications, or otherwise interact with the Services. It also explains your privacy choices and how to contact us.

This Privacy Policy provides information about our practices; it does not itself obtain your consent to marketing or optional tracking. Where consent is required, we request it separately. If this Privacy Policy conflicts with our Terms of Service concerning the handling of personal information, this Privacy Policy controls. Nothing in this policy limits rights that cannot be waived under applicable law.

1. Personal Information We Collect

"Personal information" means information that identifies, relates to, or can reasonably be linked to an individual. It does not include information that has been de-identified so that it cannot reasonably be linked to an individual, subject to applicable law.

The information we collect depends on how you interact with us and may include:

Contact information. Your name, email address, telephone number, billing address, and shipping address.

Account information. Your account identifier, login or authentication information, preferences, and account settings, depending on the account features you use.

Shopping and transaction information. Products you view, items you place in a cart or wishlist, checkout activity, purchases, order details, payment confirmations, shipping information, returns, exchanges, cancellations, and purchase history.

Payment information. Information needed to process and support a payment. Payment providers process the card, account, or other payment credentials required for your chosen payment method. We receive transaction, billing, payment-status, and related information needed to fulfill orders and handle refunds, disputes, and customer support. The payment provider's own privacy notice may also apply to its processing.

Communications and content you provide. Customer service messages, inquiries, reviews, feedback, and any photographs, documents, or other information you choose to provide to us.

Device and interaction information. Your IP address, browser and device information, cookie and similar identifiers, pages and products viewed, referring pages, navigation, clicks, scrolling, and other interactions with our website. We may also receive delivery, opening, clicking, and similar interaction information about our communications.

Preferences and related records. Your communication preferences, subscription and consent records, opt-out requests, and interests inferred from your shopping activity and interactions with us.

Please do not send full payment card numbers, passwords, government identification documents, or other sensitive information through ordinary email, chat, or public reviews unless we specifically provide an appropriate method and explain why the information is needed.

2. Where Personal Information Comes From

We collect information directly from you when you browse, place an order, create an account, contact us, submit content, or sign up for communications.

We collect information automatically through cookies, pixels, local storage, server logs, and similar technologies when you interact with the Services or our communications.

We also receive information from Shopify and the providers that support payments, fulfillment, shipping, customer service, analytics, and marketing, as well as from partners or other third parties involved in your interactions with us. We may combine information from these sources when permitted by applicable law and consistent with your choices.

3. How We Use Personal Information

Operating the store and fulfilling orders. To process payments, provide products, arrange shipping, manage accounts, remember cart contents and preferences, and handle returns, exchanges, refunds, and related requests.

Customer service and essential communications. To respond to inquiries and send messages about orders, deliveries, accounts, security, or other service matters.

Personalization and improvement. To understand how customers use the Services, troubleshoot problems, evaluate site performance, recommend relevant products, and improve our website and customer experience.

Marketing and advertising. To send permitted promotional communications, including subscribed email and text messages; provide cart reminders; measure campaign performance; and deliver or measure advertising, including interest-based advertising where permitted. These activities are subject to applicable consent requirements and opt-out rights.

Security and legal obligations. To detect and address fraud, misuse, and security incidents; maintain business records; comply with legal requirements and valid legal process; resolve disputes; and establish, exercise, or defend legal rights.

We will provide additional notice and obtain consent when required before using personal information for a materially different, incompatible purpose.

4. Email and Text Message Marketing

Email communications

We use your email address and relevant shopping or interaction information to send marketing emails when permitted by law and your preferences. These may include product announcements, offers, restock information, and cart reminders.

You can unsubscribe from promotional emails using the unsubscribe link in a message or by contacting us. Unsubscribing from promotional emails does not prevent necessary, non-promotional emails about your orders, account, or customer service requests.

Text message communications

When you separately opt in to our SMS or MMS marketing program, we use your telephone number and relevant subscription, shopping, and interaction information to send the messages described at signup. These may include recurring automated promotional messages, product announcements, offers, restock alerts, and cart reminders.

Providing a telephone number for shipping, customer service, or another transaction does not, by itself, enroll you in marketing texts. Agreeing to receive emails does not constitute consent to receive marketing texts. Consent to marketing texts is not a condition of purchase.

Message frequency varies. Message and data rates may apply. Our text message marketing program is limited to individuals who are at least 18 years old and have reached the age of majority where they live.

Cart reminders. Our website uses cookies and similar technologies to keep track of products placed in a shopping cart and identify when a cart or checkout has been abandoned. We use this information to determine whether and when to send cart reminders. We send marketing cart-reminder texts only with the required SMS consent; website activity or acceptance of cookies alone does not provide that consent.

Opting out and obtaining help. Reply STOP to unsubscribe from our text message program. You may also contact us or communicate another reasonable request to withdraw consent. For help, reply HELP or contact support@forged-racing.com. We honor withdrawal requests as required by applicable law. We may send one non-promotional message confirming an opt-out. We will not rely on this Privacy Policy to continue sending texts that require consent after you withdraw that consent.

Protection of SMS subscription information. Mobile numbers collected for our text message program, text messaging originator opt-in data, and consent records will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes. We may disclose this information to service providers and telecommunications partners as necessary to operate and deliver the program, process opt-outs, or provide support, and when disclosure is legally required. These restrictions override any broader marketing-sharing language elsewhere in this policy.

We may retain limited consent and suppression records as necessary to document your preferences, honor opt-outs, and meet legal requirements. Opting out of marketing does not automatically require deletion of information needed to fulfill orders or comply with legal obligations.

5. Cookies, Analytics, and Marketing Technologies

We and our providers use cookies, pixels, local storage, and similar technologies to operate the Services and, where permitted, support analytics, personalization, and advertising.

Some technologies are necessary for functions such as maintaining a cart, supporting checkout, authentication, security, and remembering privacy choices. Others help measure website and campaign performance, understand browsing behavior, recognize returning visitors, and provide relevant communications or advertising.

Where applicable law requires consent for optional technologies or related processing, we request that consent before the relevant use. You can manage available choices through the cookie controls on the Services and the privacy-choice methods in Section 8.

You may also adjust your browser settings to block or delete cookies. Doing so can affect website functionality. Browser cookie controls do not necessarily stop every form of information collection, such as server logs or permitted cookieless measurement, and are not a substitute for exercising applicable advertising opt-out rights.

Klaviyo

We use Klaviyo for email and text message marketing, subscription management, customer profiles, and marketing measurement. Information processed for these functions may include contact details you provide, consent and preference records, order information, browsing and cart activity, and interactions with our messages.

This information helps us manage subscriptions, personalize communications, and send permitted automated messages, including cart reminders. Klaviyo processes information on our behalf for these functions. Learn more through Klaviyo's privacy information.

Microsoft Clarity

We use Microsoft Clarity to understand website interactions through behavioral analytics, heatmaps, and session replays. Clarity captures information about pages and on-screen content, mouse movements, clicks, scrolling, device and browser details, and related usage information. Recorded page content depends on the pages visited and the applicable recording and masking settings.

Clarity uses first-party and third-party cookies and other technologies. We use its information to understand customer experiences, troubleshoot issues, and improve our website and marketing. Microsoft also processes information as a separate controller and may use it for its own purposes, including service improvement, security, and advertising, subject to applicable settings, consent requirements, and its privacy notice.

See the Microsoft Privacy Statement for information about Microsoft's practices and choices. The cookie and privacy choices described in this policy also apply to our use of these technologies; blocking cookies alone does not necessarily stop all Clarity processing.

Other analytics and advertising partners

Our analytics and advertising partners may collect identifiers, browsing and shopping activity, and interaction information through their technologies or integrations with the Services. They may use information about activity over time and across websites to measure advertising and provide interest-based advertising, subject to applicable law and your choices.

Some providers process information on our behalf, while others determine their own purposes for certain processing. Their privacy notices apply to those independent activities. Our disclosure of information remains subject to our obligations under applicable law and this policy, including the SMS restrictions above.

6. Our Relationship With Shopify

Shopify hosts our store and processes information to support the Services, including checkout and other commerce functions. Information submitted through the Services is shared with Shopify and relevant providers needed to operate those functions.

We also use Shopify enhanced features that may combine information about your interactions with our store with information from interactions with other merchants and Shopify. Shopify uses this information to provide and improve those features, including personalization and advertising-related services where permitted.

For processing where Shopify determines its own purposes and means, Shopify is responsible for handling applicable privacy requests relating to that processing. You can learn more in the Shopify Consumer Privacy Policy and submit relevant requests through Shopify's Privacy Portal. You may still contact us about information we control.

7. How We Disclose Personal Information

Providers that support our business. We disclose relevant information to Shopify and providers that support hosting, information technology, payment processing, fraud prevention, shipping, fulfillment, customer service, data storage, analytics, and email or text message delivery. The information disclosed depends on the function being performed.

Advertising and marketing partners. Subject to applicable law and your choices, we disclose relevant identifiers, contact information, shopping activity, device and usage information, and related preferences to partners that help deliver, personalize, or measure advertising and marketing. Information protected by the SMS-specific restrictions in Section 4 is excluded from sharing for another party's own marketing.

At your direction. We disclose information when you request or authorize it, such as when you choose a payment or delivery service or interact with an integrated third-party feature.

Legal, protective, and business-transfer purposes. We may disclose relevant information to comply with law or valid legal process, prevent fraud or harm, protect rights, resolve disputes, or in connection with a proposed or completed merger, acquisition, restructuring, sale of assets, or similar transaction, subject to applicable legal protections.

Certain advertising-related disclosures can be considered a "sale," "sharing," or processing for "targeted advertising" under privacy laws, even when no money is exchanged. Applicable opt-out methods are described below.

8. Your Rights and Choices

Depending on your location and the laws applicable to our processing, you may have rights to access or know about personal information, obtain a portable copy, correct inaccuracies, request deletion, restrict or object to certain processing, withdraw consent, and opt out of sale, sharing, targeted advertising, or certain profiling or automated decision-making.

Some rights apply only in particular circumstances and are subject to legal exceptions. Withdrawing consent does not affect processing that was lawful before withdrawal.

Advertising opt-outs and privacy signals

We honor legally recognized opt-out preference signals, including Global Privacy Control (GPC), as required by applicable law. A valid signal is treated as an opt-out request for the browser and device that sends it and, where required and reasonably linkable, for the associated consumer or account. Browser- or device-based choices may need to be repeated when you change browsers or devices or clear stored preferences. This does not limit any obligation to apply a recognized request to information we can associate with you. Opting out does not necessarily stop all advertising; you may still see non-personalized advertisements.

Except for legally recognized opt-out preference signals, we do not respond to browser "Do Not Track" signals.

Making a privacy request

Contact us using the details in Section 15. Please explain your request and provide enough information for us to locate the relevant records. We may request reasonable information to verify requests when permitted or required by law. We use verification information for that purpose rather than unrelated marketing. We do not require you to create an account to submit a request.

Where permitted by law, an authorized agent may submit a request on your behalf. We may request proof of the agent's authority and, where appropriate, confirmation of your identity. We do not require identity verification for an advertising opt-out when applicable law prohibits doing so.

We respond within the periods required by applicable law and explain applicable extensions or denials. We will not discriminate against you for exercising your privacy rights.

Appeals, complaints, and accessibility

To appeal a privacy-request decision where an appeal right applies, contact us and identify the decision you wish to appeal. We will review and respond as required by applicable law. You may also complain to the appropriate privacy regulator or other competent authority.

9. Additional Information for Certain Regions

United States

For purposes of applicable U.S. state privacy laws, the information described in Section 1 includes identifiers, customer records, commercial information, internet or other electronic activity, customer-provided communications or content, and inferences. The sources, purposes, and recipient categories are described in Sections 2, 3, and 7.

Payment credentials and account-access information may qualify as sensitive personal information under certain laws. We process such information to support requested transactions and accounts, protect security, and meet legal obligations. Where the law gives you a right to consent to, or limit, particular uses of sensitive information, you may exercise that right through the methods in Section 8.

Where applicable law requires affirmative authorization before selling or sharing a minor's personal information, we will not engage in that processing without the required authorization. Additional information about our marketing age restrictions appears in Section 10.

European Economic Area and United Kingdom

Where the relevant data protection laws apply, our legal bases depend on the purpose of processing:

Contract. Processing necessary to take steps you request before a purchase or to perform our contract with you, such as processing an order, arranging delivery, and handling contractual service requests.

Legal obligations. Processing necessary to meet applicable accounting, tax, consumer-protection, and other legal requirements.

Legitimate interests. Processing necessary for interests such as securing the store, preventing fraud, responding to inquiries, maintaining appropriate business records, and improving the Services, where those interests are not overridden by your rights. This basis does not replace consent where consent is legally required.

Consent. Processing for which we request your consent, including optional tracking and marketing where required. You can withdraw consent using the relevant cookie controls, unsubscribe methods, or contact details in this policy.

Where information is required to complete a transaction, choosing not to provide it may prevent us from processing the order or providing the requested service.

In addition to the rights described in Section 8, you may object to processing based on legitimate interests and to direct marketing, and request restriction of processing where applicable. You may complain to your competent supervisory authority. In the UK, you can contact the Information Commissioner's Office. You do not have to contact us before exercising a right to complain to a regulator.

10. Children and Marketing Age Restrictions

The Services are not directed to children under 13, and we do not knowingly collect their personal information. Our email marketing program is not directed to children under 13 or, in the EEA, children under 16. Children below the applicable minimum age should not enroll in these marketing programs.

Our text message marketing program is limited to individuals who are at least 18 and have reached the age of majority in their jurisdiction.

If you believe a child has provided information contrary to these restrictions or applicable law, a parent or guardian may contact us. We will take appropriate steps to address the information and any associated subscriptions, including deletion when required by law.

11. Security and Retention

We use reasonable administrative, technical, and organizational measures designed to protect personal information. No system or transmission method can be guaranteed completely secure. Protect your account credentials and avoid sending sensitive information through unsecured channels.

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, subject to applicable legal requirements. Retention depends on the type of information and its purpose:

Orders and payment-related records are retained as needed to fulfill transactions, provide related service, handle returns or disputes, and meet applicable accounting, tax, and recordkeeping requirements.

Account information is retained as needed to operate the account and requested Services, subject to applicable deletion rights and necessary legal retention.

Customer communications and submitted content are retained as needed to address the relevant matter, maintain appropriate service records, resolve disputes, and meet legal requirements.

Marketing profiles, consent records, and suppression records are retained according to the ongoing marketing relationship, applicable permissions, the need to demonstrate consent, and the need to continue honoring opt-outs.

Device, browsing, analytics, and session-replay information is retained according to its operational or measurement purpose, applicable provider settings, and legal requirements, rather than indefinitely solely because it has been collected.

We may retain relevant information longer when legally required or reasonably necessary to establish, exercise, or defend legal claims. When information is no longer needed, we delete or de-identify it as appropriate. Backup copies may remain until removed through the applicable backup cycle and are not used to restart marketing after an opt-out.

12. International Processing and Transfers

We and our providers may store, access, or process personal information in the United States and other countries where we or they operate. Those countries may have privacy laws that differ from the laws where you live.

Where EEA or UK transfer restrictions apply, transfers are subject to an appropriate legal mechanism and any required additional safeguards. Depending on the recipient and destination, these may include an applicable adequacy decision or approved standard contractual clauses, together with relevant UK transfer terms where required.

Contact us for information about the safeguards applicable to a particular transfer and how to obtain a copy, subject to appropriate protection of confidential information.

13. Third-Party Websites and Public Content

The Services may link to or integrate with third-party websites, services, payment methods, or social platforms. Their independent processing is governed by their own privacy notices. Linking to a third party does not by itself mean that we endorse its practices.

Information you choose to post publicly, such as a review or social-media comment, may be visible to others. Avoid including information in public submissions that you do not want others to see. This section does not limit our responsibilities for disclosures we make or providers acting on our behalf.

14. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices, Services, or legal requirements. We will post the revised policy and update the "Last updated" date. We will provide additional notice and obtain consent when required by applicable law.
